If you or someone you care about recently received a DUI, 

Likely when you received your DUI, the officer filled-out, and had you sign, a sheet of paper (usually Pink). 

In the lower left-hand corner, should be the document title “DS 367 M (REV. 1/2019)”, or more commonly referred to as your “DS 367”.  Not always, but usually the officer will take and keep your ‘regular’ driver’s license.  This sheet of paper (DS-367) operates as your license. However, without intervention, it is only good for 30 days and your license (and driving privileges) will be automatically suspended or revoked 30 days after your arrest.

On the front of your DS-367, about half-way down the page, will be a section with the heading “HEARING INFORMATION”.  The first line of this section reads:

YOU HAVE 10 DAYS FROM RECEIPT OF THIS NOTICE TO REQUEST A HEARING TO SHOW THAT THE SUSPENSION OR REVOCATION IS NOT JUSTIFIED.

Although the letters “10 DAYS” is in a slightly different color than the rest of the text, many people either don’t see it, aren’t sure what to do, or choose to ignore it hoping nothing bad will happen.  However, not handling this immediately, or not dealing with it at all will likely lead to an automatic license suspension.

The ‘request’ for the hearing (referred to as the Administrative Per Se hearing, or “APS” hearing) must be made within 10 days of your DUI arrest / being notified of your 10-day right. It may help to know that, the hearing itself does not need to ‘occur’ within those 10 days.  To schedule a hearing, you must call your local DMV Driver Safety Office as soon as possible to make sure you do not miss your 10-day deadline, or you can call an attorney to handle this for you.
